After talking to the DWD, I was told if my policies say that unused sick leave is not reimbursed if an employee is fired or quits, I did not have to pay. We went with something an employee had recommended. When you work 2000 hours you get 40 hours off time. This can be "banked" for up to two years but you lose it, if you terminate your job. This helped my part time people eventually get time off and then I didn't feel bad about not rewarding staff who volunteered to leave when things were slow. In the past you had to be full time 37 hours per week six months before you could use your week. No time off for part time. Staff seem to be happier with this new solution.
But is it legal?
