Unfortunately, my role here is not to provide legal advice. That being said, I will venture an educated guess based on various assumptions. First, I am assuming that you are offering this employee 6 hours of work per day and he is choosing to only work 5. I also am assuming that you are treating him no differently than you would treat any other employee who was taking off time for medical treatment. If both of those assumptions are true, then it sounds as if you should be on sound ground. However, I suggest you present a more complete picture of the situation to your center's attorney to get a formal legal opinion.
