Workers' compensation rights are determined by individual state laws. But in general employers are required to carry workers' compensation insurance to compensate employees for injuries or illnesses arising out of and during the course of employment. It may be that your daughter's employer challenged her claim that her injury was work-related and it simply took that long for the claim to be accepted by the work comp insurance carrier.

One interesting aside: most folks tend to look at workers' compensation laws as being solely a benefit to workers. Actually, historically workers' compensation laws arose for the protection of EMPLOYERS so that there would be limitations on their liability for accidents to workers in their workplace. Interesting, huh?!
