What about unemployment and termination, like Lana asked? I thought that if I terminated after 3 months of employment, I would be responsible for unemployment. What would happen if the person’s hours were reduced due to lack of need, and they voluntarily terminate. In that case, I am not responsible for unemployment, right?

When an employee resigns, I ask for their resignation in writing. If they do not provide it, I type up a simple statement that states something like this:

“On March 1, 2007, I notified Amy Weseloh of Fox Valley Home Day Care that March 12, 2007 will be my last date of employment with Fox Valley Home Day Care as I chose to terminate my employment with Fox Valley Home Day Care.” I ask that the person sign it.

I thought that this would eliminate any possible unemployment claim, if the previous employee tried to say that I terminated the employment. Also, if I have their resignation in writing, and filled the position prior to their elective last day, I would let them go and advise that that their services would no longer be needed and thank them for the time that they were employed by me. I am not obligated to retain the employee once the chose to terminate their employment, right?
