Here is a draft of a possible policy on forbidding staff from babysitting for center families.

Following that, I will offer a "hold harmless" form for families to sign should they insist on hiring a staff member, regardless of your written policy.

W/ both of these, you will need to check in w/ your attorney to make sure these are the right approach for your program. As i noted before, I cannot serve as your attorney. However, I can offer some ideas to help you get started.

POLICY FORBIDDING EMPLOYEES FROM BABYSITTING FOR PROGRAM FAMILIES

Employees of our program, ____________, are not permitted to babysit for families whose children are in our program.

PARENTS COMMITMENT TO "HOLD OUR PROGRAM HARMLESS" SHOULD THOSE PARENTS CHOSE TO HIRE PROGRAM EMPLOYEES TO BABYSIT, DESPITE OUR WRITTEN POLICY AGAINST THIS.

I/We/parents of ________, agree to hold __________Program harmless for any wrong doing that may occur as a result of our choice to hire a program employee in a babysitting capacity, despite the program's prohibition against this.
